PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. BY USING THIS WEBSITE OR BY DOING SERVICE BOOKINGS FROM THIS WEBSITE YOU AGREE TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.


“EWS” means ELITE WORLD SERVICES PVT LTD

www.airportporterservice.com (A Specialized Service unit owned & managed by Elite World Services Pvt Ltd)

“Booking Process” means actions steps by Passenger for undertaking the Service booking through online or through an offline mode as may be acceptable to Elite World Services Pvt. Ltd. (EWS)

Further, we wish to inform you that Elite World Services Pvt Ltd (EWS) offers its specialized Airport Porter Service unit to its traveler or a passenger, related to assisting with their Loads/Baggage at various Domestic and International Airports in India.

“Passenger(s)” means the person(s) to whom the Service is being rendered/intended to be rendered by the Passengers. It may be noted that some individual Passenger may also be the Passenger.

“Porter” means Airport Representative, designated or arranged by EWS or its licensed Vendor to provide Service to the Passenger(s) at Airport.

“No Show” means the failure by Passenger to reach the meeting point or identify himself/herself to Airport Representative or if in case service not required at the time of identification.

“Online Booking or engine” means the online facility provided on the Website and is available to Passenger(s) for undertaking booking/cancellation of Services subject to the applicable terms and conditions, as provided on the Website or as, maybe agreed by EWS separately in writing.

“AIRPORT PORTER SERVICE” or “Service(s)” means paid Services provided by EWS at the Airport and as detailed in Clause 2 below and as may be amended from time to time by EWS and made available on the Website.

“Member” any entity authorized by EWS in writing on mutually agreed terms and conditions for undertaking bookings and reservations of Airport Porter Services on behalf of their client(s) in India and/or abroad.

SCOPE OF AIRPORT PORTER SERVICE:

The scope of Services includes the service and its inclusions broadly defined under the following categories:

2.1 Departure Porter Services: Baggage/Luggage/Loads carried out to a Passenger for its International or Domestic flight by EWS

2.2 Arrival Porter Services: Baggage/Luggage/Loads carried out to a Passenger arriving on International or Domestic flight by EWS

ONLINE BOOKING:

3.1 Passenger must complete the Booking Process on the Website in advance for availing Services and confirmation of Services pursuant to all online and offline request by Passenger(s) EWS shall be subject to availability.

3.2 Passenger(s) shall use Online or Booking engine to make a booking for the Services.

3.3 The bookings can be made by the Passenger(s) for Porter Service available online by EWS from time to time subject to Clause 4.7 below.

3.4 Passenger can book online for up to 07 Airport Representatives, per booking. For group bookings (more than 07 Passengers) Passenger(s) may contact EWS on contact details provided on the Website: https://spicejet.airportporterservice.com

3.5 Passenger is responsible for providing EWS with correct and legitimate detail(s) about itself and its Passenger(s) during the Booking Process. EWS at all times shall reserve the right for taking any additional information about/to/with concerning to the Passenger(s) during the process of online/offline booking or anytime during the performance of Services or any clarification thereafter.

3.6 Any and/or all request(s) as may be received and acknowledged by EWS does not guarantee the Service by EWS and shall be subject to written confirmation by EWS

3.7 EWS reserves the right to accept or decline or cancel Passengers request for Service without assigning any reasons.

3.8 During the Booking Process the Passenger(s) are requested to take extra care while providing information about the Passenger(s), date and time of travel, contact numbers. etc. EWS assumes no responsibility whatsoever on the account of any problem that may arise on account of false/ erroneous information provided by Passenger(s) to EWS or any delay or cancellation of flight or for any reason whatsoever including any major event, change in flight schedule, failure of Passenger(s) to report at the airport on time.

3.9 Once the Booking Process is completed, Passenger can request for cancellation of Services in case of any changes in travel plan and EWS shall initiate the refund process online with the Cancellations and Refund Policy provided in Clause 5 below. However, the cancellation and refund to the Client(s) of any Member must be processed through the issuing Member-only subject to the cancellation and refund policy.

3.10 It is hereby clarified that during the process of booking by Online Engine on our Website, if there is any “transaction fee” which is charged by the bank issuing the credit/debit card, such charges shall be paid by the Passenger and EWS shall have no liability to pay such a transaction fee.

3.11 All Members shall deal with their clientele by themselves and EWS assume no responsibility for transaction between Member and its client. For all confirmed and legitimate Service(s) bookings by Member(s), EWS shall only be responsible for providing Service(s) to Passenger(s), subject to the terms and conditions of Porter Service at the Airport.

3.12 CREDIT/DEBIT CARD:

Payment of online booking is accepted by all major credit/debit card (“Card”). In case the card used to transact online is issued in a country other than India there may be bank charges applicable and EWS shall not responsible for any charges that may be levied by the Card Issuing Bank. The Card payment is subject to authorization from the bank issuing the Card.

3.13 NET BANKING:

If the Passenger has an account with any of the mentioned banks under the heading net banking on our Website, then Passenger can pay for the booking(s) securely through the respective bank Internet banking option and the amount will be automatically debited from your account. EWS is not liable for any payment authorization, as the payment gateway is responsible only to hand over the information in an encrypted/secure format to the respective bank for authorizing the transaction. Any issue with payment authorization will need to be taken up with your respective bank. This facility is valid for all bookings made in Indian Rupees (INR) currency only.

CONDITIONS OF SERVICES AT AIRPORT LOCATION:

Performance of Services to Passenger(s) by EWS at the Airport shall be subject to the following conditions:

4.1 Passenger shall identify himself/herself to our Airport Representative or call on the number provided on booking confirmation on Arrival or Departure at Airport.

4.2 Passenger(s) shall be solely responsible for compliance with all governmental regulations upon utilities used while departing or arriving at the airport and ensuring that all required documents are in order and also comply with all conditions/requirements stipulated by the Government of India and other relevant authorities and agencies in relation to their Air Travel.

4.3 Service by EWS to Passenger(s) shall be subject to written confirmation of Service.

4.4 Duration of Service: The performance of Service will commence at the scheduled meeting time or the time of service as per the booking confirmation. However, EWS at its sole discretion may permit Passenger(s) a window of 10 (Ten) minutes from the scheduled meeting time to avail the Porter Service(s).

4.5 In case of any failure of Passenger(s) to report on time at the meeting point or the time of service as per the booking confirmation, she/he shall be deemed as a NO SHOW and the Service will not be assured.

4.6 For each booking of service, Baggage/Luggage of 02(Two)Pcs carried out to Passenger(s). Passengers shall provide the requirement of porter service during the Booking Process.EWS may accept the additional requirement of porter services on payment of additional charges on the spot, subject to availability.

4.7 EWS shall at its sole discretion, be entitled to cancel, alter or omit any part of the Service with or without notification to Passenger(s) at its sole discretion. In such cases, EWS’s liability shall be limited to re-performance of the canceled Service. In cases where EWS is unable to re-perform the service, a partial/full refund may be provided by EWS to the Passenger(s) at its sole discretion.

4.8 Delays and cancellations of Service by EWS may result from factors beyond its control such as accidents, governmental restrictions, and other events of force majeure, EWS’s liability shall be limited to re-performance of the cancelled Service.

4.9 EWS at all times shall reserve the right to withdraw the Porter Service without assigning any reason and without further reference, in case the Passenger(s) is/are in breach of any term and condition of the Porter Service.

4.10 Passenger shall not use the Porter Service or its reference for any unlawful or prohibited purposes.

4.11 EWS at its sole discretion may decline to provide Service in case of any misconduct or any unlawful or prohibited activity by the Passenger(s).

4.12 For all products, and services provided by third parties (for example, limousine transfers, floral deliveries, hotels reservation.), the terms and conditions, cancellation and refund policies of such third party shall be applicable. EWS shall not be liable to Passenger(s) regarding any product and service provided by any third party.

4.13 EWS’s liability, if any, shall in no event exceed the total charges paid by the Passenger(s) for the Services. Under no circumstances, EWS shall be liable for any consequential, exemplary, special, indirect, incidental, or punitive damages.

4.14 Passenger(s) agrees to indemnify EWS with respect to all claims, damages, losses, costs, and expenses (including legal expenses) which are awarded against or incurred by EWS as a direct result of acts or omissions by Passenger(s) either during the course of booking and/or using the Porter Service.

4.15 EWS shall not be liable for the consequences of any delay or for any loss, cost, or expense incurred by Passenger(s) as a result of the actions of any other party including without limitation the Airline, Customs and Immigration Authorities, etc.

4.16 In relation to the Service, EWS accepts no liability for any items left or disclaimed by the Passenger(s) during the course and after providing the Service.

4.17 By offering Services, EWS does not accept any liability for damages, losses, or delays that may result on account of improper documents including without limitation possession of a valid ticket, visa, passport, or any other requirement in relation to entry, exit, length of stay, special permissions, etc. as may be required for traveling through EWS

Passenger(s) acknowledge and agree to inform Passenger(s) of these Terms and Conditions including with Conditions of Service at the airport provided above.

CANCELLATION & REFUND POLICY TERMS:

5.1 Guest(s) if they wish to cancel their booking must request for the cancellation of booked service by notify in writing to EWS with the booking details and a reason for cancellation. EWS shall review such cancellation request(s) for its authenticity and once approved by EWS, the service booking will be cancelled and refund process will be initiated and necessary credit will be provided to the Facilitator subject to the deduction of applicable cancellation charges. Refer below specification provided under the cancellation of services.

5.1.1 Cancellation by Passenger:-

5.1.1.1 Any cancellation of services made within 48hrs prior to the scheduled arrival or departure facilitation, the 50% refund will be processed (excluding processing fee). 

5.1.1.2 Any cancellation of services made less than 24hrs to the scheduled arrival or departure facilitation, no refund will be processed.

5.1.2 Cancellation/Amendment by Airline:-

5.1.2.1 Flight Cancelled by Airline – Customer should be entitled for 100% refund, if cancellation of flight informed to EWS Prior 06 Hours & 12 Hours of Service time for domestic & International service respectively.

5.1.2.2 Flight postponed by more than 120 mins by Airlines – If flight postponed information received by EWS prior 06 Hours & 12 Hours for Domestic & International flight respectively, then service scheduled to next flight, No refund applicable, Otherwise No show.

5.1.2.3 Flight preponed by more than 90 mins by Airlines – If flight preponed information received by EWS prior 06 Hours & 12 Hours for Domestic & International flight respectively, then service scheduled to next flight, No refund applicable, Otherwise No show.

5.1.3 No refund will be made in case of the following:-

5.1.3.1 Wrong information about travel details of Guest(s) during the Booking Process;

5.1.3.2 No SHOW of Porter service;

5.1.3.3 Late arrival at the airport which results in denied check-in or boarding by the airlines;

5.1.3.4 In case of any misconduct or any unlawful or prohibited activity by the Guest(s).

Note: EWS shall endeavor to process the refund if applicable, within 15 working days from the date of cancellation.

# Cancellation and Refund policy has been revised time to time as per policies revised by airline and airport authorities.

PRIVACY:

5.2.5 ELITE WORLD SERVICES PVT LTD believes strongly in protecting user privacy. Please refer to EWS privacy policy, incorporated by reference herein that is posted on the Website, www.airportporterservice.com

CUSTOMER SOLICITATION:

5.2.6 Unless you notify our Airport Representative, while they are calling you, of your desire to opt-out from further direct company communications and solicitations, you are agreeing to continue to receive further emails and call solicitations EWS and its designated in house teams(s).

OPT-OUT PROCEDURE:

5.2.7 We provide easy and simpler ways to opt-out from future solicitations. You may also choose to opt-out, via sending your email address to airportporterservice.com OR You may send a written removal request to the office at. AIRPORT PORTER SERVICE c/o ELITE WORLD SERVICES PVT. LTD. Elite Tower, 1st Floor, G-364/B, Raj Nagar-II, Palam Colony, New Delhi-110077 India.

GENERAL TERMS:

The scope of Services includes various services and packages broadly defined under the following categories:

6.1 EWS reserves the right to amend, add to, change or remove any part of these Terms and Conditions at any time, without notice. Any changes to these Terms and Conditions or any terms posted on the website apply as soon as they are posted. By continuing to use the Website after any changes are posted, you are indicating your acceptance of those changes.

6.2 EWS may add, change, discontinue, remove or suspend any other content posted on the Website, including features and specifications of products described or depicted on the Website, temporarily or permanently, at any time, without notice and without liability.

6.3 EWS reserves the right to undertake all necessary steps to ensure that the security, safety and integrity of EWS systems, as well as its client’s interests, are, and remain, well-protected.

6.4 EWS may take various steps to verify and confirm the authenticity, enforceability and validity of reservations placed by Passenger(s).

6.5 EWS in its sole and exclusive discretion, concludes that any booking(s) is not or do not reasonably appear to be, authentic, enforceable, or valid, then EWS may cancel the said booking any time before or during the Service.

6.6 Any communications or materials to the Website by electronic mail or otherwise, including any comments, data, questions, suggestions or the like, all such communications are, as may be received by EWS will be treated by EWS as non-confidential.

6.7 Passenger(s) hereby give up any and all claim that any use of such material violates any of Passenger(s) rights including moral rights, privacy rights, proprietary or other property rights, publicity rights, rights to credit for material or ideas, or any other right, including the right to approve the way EWS uses such material.

6.8 Any material submitted to our Website may be adapted, broadcast, changed, copied, disclosed, licensed, performed, posted, published, transmitted, or used by EWS anywhere in the world, in any medium, forever. Passenger(s) agrees that it has read our Privacy Policy as provided on our Website.

6.9 Passenger(s) acknowledges that Internet transmissions are never completely private or secure. Passenger(s) further understands that any message or information as may be sent to our website may be read or intercepted by others unless there is a special notice that a particular message (for example, credit card information) is encrypted (send in code). Sending a message or email or any communication written or verbal to EWS does not cause EWS to have any special responsibility to Passenger(s).

6.10 Copying of part or all the contents of this website without permission of EWS is prohibited except to the extent that such copying/printing is necessary for the purposes of availing of the Services.

6.11 Disputes, if any, shall be subject to Indian laws and shall be exclusively subject to the jurisdiction of the courts in New Delhi.

6.12 The booking for Services displayed on this website may not be available for purchase in any particular country or locality. The reference to such Porter Services on the website does not imply or warrant that the booking of Services will be available at any time in such a particular geographical location(s). Person or entity interested in booking the Services may check with their local members for information on the availability of Services.

PROPRIETARY RIGHTS:

7.1 EWS has proprietary rights and secrets in our services and products. EWS also has rights to all trademarks and trade dress and specific layouts of this webpage, including calls to action, text placement, images and other information.
